Appeals court upholds sentencing

The Ohio Sixth District Court of Appeals has upheld the sentencing of a Walbridge man who had entered a guilty plea to charges of domestic violence, abduction, aggravated assault, and tampering with evidence.
Harley Harris was charged April 2022 in a 10-count indictment for alleged offenses against a female victim throughout the month of December 2021. Count one charged him with aggravated menacing, a first degree misdemeanor. Counts 2,4,5,7 and 8 charged him with domestic violence, all first degree misdemeanors except for count 8, a fifth degree felony. Counts 3, 6, and 9 charged him with abduction, all third degree felonies. Count 10 charged him with tampering with evidence, a third degree felony.
Pursuant to a plea agreement, Harris pled guilty in Wood County Common Pleas Court to all charges except for count 1. Also, count 8 was amended to reflect a fourth-degree charge for aggravated assault.
During a plea hearing held in June 2022, the county prosecutors said they would have established proof through a series of Nest camera videos that recorded activity in the living room at the Walbridge residence where he and the victim lived. Village police were called Dec. 30, 2021 by a neighbor who reported a disturbance outside the home. The video also shows Harris ripping the camera down.
He received a total sentence of four years in prison with some charges merged, with the sentences to be served concurrently, and others to be served consecutively.
In his appeal, Harris contended the trial court didn’t make the proper findings to impose consecutive sentences.
However, the appeals court agreed with the common pleas court decision that the sentences were proper and his “criminal history demonstrates that consecutive sentences are necessary to protect the public from future crime by the defendant.”
